- TERMS AND CONDITIONS
1.1 If you wish to access our services, including attending our events or participating in our exercise classes (Services), you must register an account with us. You may register an account directly with us or through certain third-party smartphone applications (App), such as the Hapana App (formerly One Fit Stop), available for download from the Apple App Store or Google Play. Upon registering an account, you agree to be bound by these Terms and Conditions (Terms), our Website Terms of Use, and Privacy Policy.
1.2 If you do not agree with these Terms, please do not use our Services.
1.3 We may make reasonable changes or updates to these Terms. Any changes will take effect at the earlier of:
(a) one (1) month from the date we notify you of the change; or
(b) the date you next purchase any Passes after notification of the change.
1.4 References to “we”, “us”, and/or “our” are references to The Fit Space Pty Ltd (ABN 11 627 617 823) and its related entities, affiliates, and franchisees (as relevant).
- PRICES AND BOOKINGS
2.1 Prices and class schedules may change. Current information is available on our website and App.
2.2 Participation is limited. To attend a class, you must book a space online via our website or App, or by contacting the gym directly.
- CANCELLATION POLICY
3.1 Cancellations or reschedules must be made at least eight (8) hours before class. Late cancellations or “no shows” result in forfeiture of the session.
3.2 Cancellations more than eight (8) hours before class will automatically credit the session. Late cancellations incur a $10 fee.
3.3 A minimum of three (3) participants is required for a class to proceed. We will attempt to notify you if a class is cancelled.
3.4 Entry is not permitted five (5) minutes or more after class commencement.
3.5 The Fit Space reserves the right to refuse access to any class at its discretion.
- CLASS WAITLISTS
4.1 You may join a waitlist if a class is full. If a spot becomes available, you must confirm your attendance.
4.2 Remove yourself from the waitlist if you no longer wish to attend.
- PASSES, MULTIPACKS AND MEMBERSHIPS
5.1 Individual class passes, multipacks, and memberships (Passes) must be purchased before booking.
5.2 Each Pass is subject to specific terms, including expiry and attendance requirements.
5.3 Passes are non-transferable.
5.4 Unused Passes expire on their relevant date.
5.5 Except as required by law, no refunds, transfers, suspensions, or extensions apply.
5.6 Nothing restricts any rights you may have under the Australian Consumer Law.
5.7 We may suspend or terminate Passes if fraud or misuse is suspected.
- CANCELLATION OF MEMBERSHIPS
6.1 Memberships have fixed minimum terms. Unlimited Memberships have a three (3) month minimum term.
6.2 Memberships automatically renew unless specified otherwise.
6.3 Cancellation requires two (2) weeks’ notice after the minimum term.
6.4 Early cancellation may be considered for medical, relocation, or extenuating circumstances, with supporting documentation.
- REFERRAL CREDIT
7.1 Referral credits are for Pass purchases only, valid for three (3) months, and non-redeemable for cash.
- GIFT VOUCHERS
8.1 Gift vouchers may be offered for Pass purchases.
8.2 Vouchers:
(a) are non-transferable;
(b) expire on the stated date;
(c) cannot be reloaded, refunded, resold, or exchanged for cash.
- CLASS SCHEDULES
9.1 Classes vary in length (typically 45–60 minutes).
9.2 Schedules and trainers may change without notice.
9.3 No refunds, credits, or compensation are provided for class changes or cancellations.
- CONDITIONS OF ENTRY
10.1 We reserve the right to refuse entry or remove any person for safety reasons, inappropriate attire, or disruptive behaviour.
- AGE LIMITS AND RESTRICTIONS
11.1 Minimum age for classes is sixteen (16).
11.2 Parents or guardians are responsible for participants under eighteen (18).
11.3 See clause 18 for Child Minding Terms.
- SECURITY
12.1 We are not responsible for lost, damaged, or stolen belongings.
- PROMOTIONAL OFFERS
13.1 Promotions are available from time to time. Refer to our website, App, or staff.
- DIRECT DEBIT REQUEST (DDR) SERVICE AGREEMENT
14.1 Memberships require a DDR Service Agreement to authorise billing.
14.2 The DDR Service Agreement forms part of these Terms.
14.3 Failed payments may incur administrative fees or suspension until payment is received.
- PERSONAL INFORMATION
15.1 Managed in accordance with our Privacy Policy: thefitspace.com.au.
- SAFETY AND LIMITATION OF LIABILITY
16.1 Notify staff of pregnancy, injury, or medical conditions prior to class.
16.2 Staff guidance is not medical advice. Consult your healthcare professional.
16.3 Stop immediately if you feel pain or discomfort.
16.4 Instructors may use tactile cueing for technique correction.
16.5 Participation involves inherent risk. We exclude liability except in cases of reckless conduct.
16.6 We are not liable for indirect, consequential, or incidental loss, except as required by law.
- JURISDICTION
17.1 Governed by South Australian law. Non-exclusive jurisdiction of South Australian courts applies.
- CHILD MINDING TERMS AND CONDITIONS
18.1 Overview: Child Minding provides supervised care for children aged 8 weeks–4 years while parents attend classes. Use of this service constitutes acceptance of these terms.
18.2 Registration and Collection:
(a) Each child must be registered for every session.
(b) Parents must arrive early and ensure children are fed and changed if possible.
(c) Parents must remain on the premises while children are in care.
(d) Parents are responsible for responding to staff requests.
(e) No parent may leave the premises during supervision.
18.3 Ratios: Maximum 5 children per supervisor.
18.4 Bookings:
(a) Pre-booking is required via online system or App.
(b) Bookings must be made at least 2 hours before class.
(c) Cancellations must be made promptly; failure may incur fees or suspension.
(d) Maximum care duration: 90 minutes.
(e) Disclose any medical, behavioural, or special considerations.
18.5 Staff Qualifications: Supervisors have minimum 12 months childcare experience or qualifications.
18.6 Behaviour Management: Positive guidance only; parents will be called if a child is disruptive.
18.7 Medication: No medication is administered; parents manage ongoing medical needs.
18.8 Time Limits: Care only while parent is in class; children not allowed outside supervised area. Service operates 15 minutes before class and 15 minutes after.
18.9 What to Bring: Pram/stroller for non-walking children, nappies, wipes, change of clothes, labelled items. No solid food.
18.10 Feeding: Parents manage feeding before or after class.
18.11 Sick Children: Do not attend if unwell; parents must collect immediately if child becomes unwell.
18.12 Liability: Ultimate responsibility remains with parents. We are not liable for injury, loss, or damage except from reckless conduct.
- PHOTOGRAPHY / MARKETING USE
19.1 Participation in classes or events constitutes consent for promotional photos or videos unless written notice is provided.
- ACKNOWLEDGEMENT AND AGREEMENT
20.1 By purchasing any Pass, Membership, or booking any class, you acknowledge that you have read, understood, and agree to these Terms and Conditions in full.
